Town Board Minutes for April 23, 2007

The Town Board of the Town of Sun Prairie met on Monday, April 23, 2007, at 7:30 p.m. at the Town Hall, 5556 Twin Lane Road, Marshall, WI.

Call to Order. The meeting was called to order at 7:30 p.m. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, treasurer Cindy Yelk and clerk Claudia Quick were present. Anita Holcomb, Alice Freitag and Brad Freitag attended the meeting.

Statement of Public Notice. The chair directed that the minutes show notice of the meeting was published in the April 19, 2007 issue of The Star; notice was also faxed to the Capital Times. Copies were also posted on the three town bulletin boards on April 20, 2007.

Pledge of Allegiance. Cindy Yelk led the pledge.

Approve Minutes of Prior Meeting. Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the April 9, 2007 meeting.

Presentation from the Public. Anita Holcomb, appeared to describe and ask for funds for the Fireman Park in the Prairie. This park is to be a fully accessible park to be located within Angell Park. No action was taken.

Allow Public Comment – Consider and Take Action re: Petition #9678 by Brad and Alice Freitag to change the zoning from A-1 Ex Ag to A-2 to separate the single family residence and buildings from the farmland, 3111 Burke Road, section 30. The petitioner indicated that there were complications with their previous petition for an identical rezone and they were not able to record their certified survey map by the deadline. Therefore they are required to go through the process again. Moved by Doug Yelk, Second by Vernon Pogue to approve the rezoning and the CSM with the addition of the neighboring use language.

Consider and Take Action re: Petition #9655 as amended by the County. Moved by Doug Yelk, second by Vernon Pogue to approve #9655 with the added condition “Condition requiring recording of a notice document with the Dane County Register of Deeds within 90 days of rezone approval, indicating that the parcel is located in a mineral extraction/protection area and that future mineral extraction activity may occur in the vicinity”.

Review Loan Rates and Take Action re: Loan for Road Reconstruction. Treasurer Cindy Yelk reported on her search for loan rates for the Highway reconstruction project. (During the 2007 Annual Meeting the town electors approved a resolution to borrow $600,000.00 for reconstruction of a portion of Town Hall Drive and a portion of Twin Lane Road.) Five lending agencies responded with loan rates ranging from 4.25% to 5.75%. Moved by Doug Yelk, second by Vernon Pogue to make arrangements with the F & M State Bank in Waterloo. Discussion indicated that the loan be finalized and the money transferred to a high yield account until such time that the road contractor invoices become due.

Audit and Pay Bills. The Board reviewed the list of invoices for April. Moved by Doug Yelk, second by Vernon Pogue to pay the April bills with the addition of the handwritten items.

Make Appointments:

  • Weed Commissioner, EMS Rep etc. The following board members were reappointed to various committees, commissions and positions.
  • Lyle Updike – Fire Unit Rep. and Municipal Court
  • Vernon Pogue – EMS Rep
  • Doug Yelk – Weed Commissioner

Old Business/New Business

  • Various Potential Zoning Violations – There was lengthy discussion concerning the various potential violations within the Town. The consensus of the Board was to refer the site/properties in question to the county’s zoning inspector.

Set Next Meeting Date/Adjournment. The next meeting date was set for May 14, 2007. Moved by Doug Yelk, second by Vernon Pogue to adjourn the meeting.
