Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Dot Havens, Alan Meyer, Paul Stang, John Quimby and Doug Yelk.  Also present:  Robert Heineman.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on September 14, 2016.

Approve the minutes of previous meeting.  Hearing no objections, the August 15, 2016 minutes were approved as submitted.

Consider and take action on a preliminary plan by Birrenkott Surveying, representing Bernie and Barbara Heinemann, to rezone 0.32 acres of a 34.8 acre parcel from A-1(Ex) Agricultural to C-1 Commercial to bring the area into compliance for its existing commercial use at 4545 Highway TT in Section 33, Town of Sun Prairie.

An issue arose regarding storm water runoff from the parking lot and soil erosion onto the farmer’s field to the east of the proposed rezoning.  A series of aerial maps taken at various intervals over the last 10 years show runoff caused erosion and the farmer built a floodway to help discharge the water from his land.

Motion by Yelk/Quimby to tentatively approve the rezoning as requested, with agreement from the applicant to accept additional legal expenses, the Plan Commission will seek legal advice from the Town’s Legal Counsel regarding water management issues.  Motion carried, 6 ayes, 1 no.

Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for October 17, 2016 at 7:00 p.m.

Adjournment.  The meeting adjourned at 8:45 p.m.
