Plan Commission Minutes

 

March 19, 2007

 

Call to Order. The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m. by Chairman Roger Fetterly. Members present other than Chairman Fetterly were: Doug Yelk, Judy Stang, Alan Meyer, Dot Havens and Kerman Crothers. Also present was Claudia Quick, Town Clerk. Member John Quimby was absent and excused.

Public Notice. Notice of the meeting was posted on the three Town bulletin boards on March 13th and was mailed out to applicants the day prior.

Approval of the Minutes.  February minutes to be amended to read: #4 – add 'federal' before government, strike last sentence and replace with 'There was no objections to the information presented.' #10 Amend motion to stipulate requirement of submission of nutrient management plan and #11 Strike 'motion failed' and replace with 'motion to deny carried'.

Public Comment. There was no comment from the public.

Public Hearing on Petition to Rezone by Schuster Family LLC.  Allow public comment on a petition by the Schuster Family LLC to rezone approximately 1 acre of a 21 acre parcel from A-1 (Ex) Agriculture to R-1 Residential for a single family home located between 5824 Prospector Lane and the Drovers Woods First Addition. There was no comment from the public.

Consider and Take Action on the Schuster Petition. Member Crothers asked Mr. Schuster if he was required to plat the single lot and Mr. Schuster replied that it was required. Member Stang made a motion to approve using the same Developmental Restrictions as first phase and Member Crothers seconded the motion. Motion carried.

Consider and Take Action on a Preliminary Plan by Stephen Drunasky. Applicant proposing to rezone 2 acres from RH-1 Residential to R-3A Residential to create 2 one acre lots to build a single family home or duplex within the next two years at 5781 Town Hall Drive. Chairman Fetterly opened discussion stating that the Township doesn't have a favorable opinion of duplexes in cases similar to this one. Chairman Fetterly also then suggested that a more appropriate rezone request would be from RH-1 to R-1A for both proposed lots. Chairman Fetterly made a motion to approve the rezone request amended to a conversion from RH-1 to R-1A for both lots. Member Stang seconded motion. Motion carried.

Consider and Take Action on a Preliminary Plan by Patrick and Barbara Bergstrom. Applicants proposing to rezone 1 acre of a 3.34 acre lot from RH-1 Rural Homes to an R-3A Residential lot to create a saleable parcel at 5701 Run Around Road. Chairman Fetterly made a motion to approve, stipulating that the rezone be from RH-1 to R-1A, also stating for the record that the Bergstrom's have already contributed to the road frontage cost. Member Stang seconded. Motion carried.

Consider and Take Action on a Preliminary Plan by Chad Killerlain for a Conditional Use Permit. Applicant proposing issuance of a Conditional Use Permit for 2-3 acres of a 32.5 acre farm parcel currently zoned A-1 (Ex) Agriculture to allow construction of a house and shed for a Limited Family Business/Home Occupation site at the south end of Ridge Road Chairman Fetterly began discussion stating that a CUP wouldn't be appropriate in this case due to the applicant not having derived income from agricultural production. Chairman Fetterly also stated that approving such a request would result in fragmentation of valuable farmland. Chairman Fetterly made a motion to deny the motion. Member Havens seconded motion. Motion to deny carried.

Consider Boundary Issues with the City of Sun Prairie. Chairman Fetterly stated that Scott Kugler, the City Planner, had requested that the Township provide for him a copy of the Town's agenda every time it meets. Member Crothers made a motion to table and Member Yelk seconded. Motion to table carried.

Review Draft Proposal of the Intergovernmental Agreement Between the Village of Cottage Grove and the Town of Sun Prairie. Chairman Fetterly began discussion indicating that the proposed agreement would yield tax sharing benefits to be used for conservation and preservation of farmland. Member Meyers went on to ask if there is a plan for how to tell the Township what is and will be happening. Chairman Fetterly replied that a public hearing will be scheduled when a final draft is developed. Chairman Fetterly then stated that a joint but equal committee will be created to deal with issues that develop.

Review the Implementation Element of the Comprehensive Plan and Consider Clarifications and Revisions to the Plan. After much discussion on how to come up with a questionnaire for the Township, it was decided that a flyer be developed and distributed at the upcoming elections.

Set Agenda for Next Meeting. Claudia Quick stated that we were caught up with Public Hearings. Freitag and Blaska are next.

Set Next Regular Meeting Date. The next regular meeting date of the Town of Sun Prairie Plan Commission was scheduled for April 16th, at 7:00 p.m.

Adjournment. The meeting adjourned at 10:00 p.m.
