Plan Commission Minutes

 

NOVEMBER 21, 2009

 

 

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following were present:  Chairman Roger Fetterly, Doug Yelk, Dot Havens, John Quimby and Judy Stang.  Absent, excused: Kennan Crothers and Alan Meyer.  Also present was Claudia Quick, Town Clerk.

 

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on December 15, 2009.

 

Approval of the Minutes.   Minutes of the November 16th and November 19th meetings were mailed to Plan Commission members prior to the meeting.  Hearing no objections the minutes were approved as presented.

 

Public Comment.  There were no members of the public wishing to speak.

 

Public Hearing on Petition #10121 by Kim Douglas:  Applicant proposes to rezone 1.967 acres from LC-1 Light Commercial to C-2 Commercial to allow automotive repair on a parcel which is currently occupied by a snowplowing and lawn care business at 4791 Norton Drive, in Section 31, Town of Sun Prairie.

 

There was no one from the public wishing to speak.

 

Consider and take action on the Douglas petition.  Motion by Stang/Havens to recommend approval of the petition with business uses limited to the following:  a. Landscaping, snowplowing and auto repair.  b. The existing metal building.  c. No retail or automotive sales on the property.  d. All landscaping and snowplowing equipment shall be stored indoors.  e. No more than 5 vehicles stored outside.  f. No outside storage of landscape material (topsoil, mulch, gravel) or auto parts.  g. Regular hours of operation 6:00 a.m. to 9:00 p.m., unlimited for snowplowing.  h. No exterior lit signage.  Motion carried  (5-0-2).

 

Consider and take action on the Rademacher preliminary plan.  Keith and Joan Rademacher request approval of a preliminary plan to rezone 3.6 acres of a 54.4 acre farm from A-1 (Ex) Agricultural to RH-1 Rural Homes to separate the farm homestead from the remainder of the farm to make it available for sale at 1696 CTH T in Section 13, Town of Sun Prairie.  Motion by Yelk/Quimby to approve.  Motion carried.

 

Consider and take action on the Hetzel preliminary plan.  Cal and Michele Hetzel request to rezone 3.8 acres of a 38.8 acre parcel from A-1 (Ex) Agricultural to RH-1 Rural Homes to separate the home from the farmland to make the farmland available for sale at 3251 Bailey Road in Section 19, Town of Sun Prairie.  Motion by Yelk/Stang to approve as proposed.  Motion carried.

 

Consider and take action on petition # 10119 by Dennis Midthun.   Proposal by Dennis Midthun, represented by Birrenkott Surveying, requests to rezone 6.642 acres from RE-1 Recreational to C-2 Commercial to allow construction of a combined warehouse, small contractor’s offices and sales/repair shops for small businesses, and 7.0 acres from A-1 (Ex) Agricultural to A-4 Agricultural to comply with the Dane County Zoning Ordinance on the remaining lands at 4100 CTH TT in Section 31, Town of Sun Prairie.

 

The Plan Commission reviewed a report on the site visit to the property which identified the characteristics of the property, including the boundaries, roads, driveway, ponds, drainage ditches, drainage pump stations, culverts, berms and a mound of hauled in fill.  The inspection verified the following:  a. There is a large pond of standing water on the north side of CTH TT.  b. Two culverts, one on the east side of the property and one on the west, allow drainage of runoff water from the north side of the road to the south.  c. A drainage pump station on the north side of the road intended to drain into the western culvert is not operating and debris is partially blocking the culvert.  d. The elevation on the north side of the road is significantly higher than the land on the south side of the road and the natural flow of water is from north to south.  e. The parcel on the south side of the road is relatively flat and has 2 abandoned baseball fields.  f. A drainage pump station on the west side of the south parcel is intended to pump drainage from the area of the ball field into headwaters of Door Creek.  The pump has not been operating recently.  g. A large mound (approximately 15,000 square feet and 8 feet high) of hauled in fill occupies a part of one of the ball diamonds.  h. A berm around the southeast side of the mound contains run-off water from the mound.

 

Motion by Yelk/Quimby to recommend approval of the petition with the following limits or conditions:

a.      Under Dane County Ordinance, 10.14 (C-2 Commercial District), (1) (a), (b) and (f).

b.      Under Dane County Ordinance, 10.13 (C-1 Commercial District), (1) (c), (j), (k) and (o).

c.      Regular hours of operation:  6:00 a.m. to 9:00 p.m. seven days a week.

d.      Elevation of the fill to be determined by the Town Board.

e.      Recording a 2 acre conservation easement under Town of Sun Prairie Ordinance.

 

Motion carried with the understanding that the approval be held in abeyance while the Plan Commission initiates and completes the process of amending the Comprehensive Plan to allow the proposed change to land use and rezoning.

 

The Plan Commission reviewed the petition for direct annexation of land to the Village of Cottage Grove and provided suggestions to the Town Clerk to respond to a questionnaire from the Wisconsin Department of Administration regarding the annexation.

 

Plan Commission discussed issues and boundary changes to be considered in a governmental agreement with the City of Sun Prairie.

 

Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for January 18, 2010 at 7:00 p.m.
