Call to Order The meeting was called to order at 7:30 p.m. by Chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk; Clerk, Claudia Quick, Attorney Mark Hazelbaker and Plan Commission Chairperson Roger Fetterly were present.

Statement of Public Notice The chair directed that the minutes show notice of the meeting was posted in accordance with State Law.

Pledge of Allegiance Roger Fetterly led the pledge.

Discussion, Consider and Take Action re: Conservation Ordinance Court Case Roger Fetterly indicated that the Plan Commission was in the process of reviewing and potentially amending the Town’s Land Use Plan. Mr. Fetterly estimated that it would take 2-3 months to complete the amendments. The amendment process at the county would take approximately an additional 3 months. The Environment, Agricultural and Natural Resources Committee and Zoning & Land Regulations should review the amendments prior to the Town’s public hearing. There was additional discussion regarding incorporating the conservation easement and additional alternatives into the Comprehensive Plan. Moved by Vernon Pogue, second by Doug Yelk to file the appeal, but ask the Court of Appeals to stay briefing on the matter until the Town of West Point case is decided. In the interim, the Plan Commission and Town Board would move ahead to modify the comprehensive plan.
