The Town Board of the Town of Sun Prairie
met on Monday, July 28, 2008 at 7:30 p.m. at the Town Hall, 5556 Twin
Lane Road, Marshall, WI.
Call to Order The meeting was called to
order at 7:30 p.m. by chairperson Lyle Updike. Supervisors Vernon Pogue
and Doug Yelk and clerk Claudia Quick were present. Eighteen people,
including two children, attended the meeting.
Statement of Public Notice The chair
directed that the minutes show notice of the meeting was posted on the
three town bulletin boards on July 25, 2008.
Pledge of Allegiance Claudia Quick led
the pledge.
Approve Minutes of Prior Meetings Moved
by Vernon Pogue, second by Doug Yelk to approve the minutes of the July
14, 2008 Town Board meeting.

Presentation from the Public No one
spoke during presentation from the public.
Discussion with McNeil re: Berlin Road
flooding issues. David and Ruth McNeill were present with two of
their adult daughters and son-in-law. Bill Kern, son-in law, spoke of
the McNeill’s flood experience in early June. He described the photos
that documented the amount of water. "It seemed like water came from
everywhere onto their lot and farm." They were at the Board meeting to
ask what could be done to prevent this water deluge again. During the
discussion the McNeill family described various items that they saw as
potential problems and solutions for the amount of water they were
getting. Prior to the meeting, Dennis Farrell, road patrolman, had
prepared a diagram indicating what he thought would address the problem.
The clerk spoke to the McNeill’s about Farrell’s sketch and his
suggestions. He suggested that drainage swales should be re-established,
as some have been blocked and some have been filled in. The water should
be contained within swales. It appears that most of the work would need
to be done on private property, but that culverts in the area would be
checked for debris. The chair asked that Supervisor Yelk talk with
Farrell about the situation. McNeil will talk with the owner of the
woods to the west of their property. No other action was taken.
Discussion re: Drovers Woods Homeowners
Association/lease Drovers Woods Park Ten residents of Drovers Woods
were present. The residents raised points of concern and question. Items
brought up were: risk of liability to individual homeowners, how many
kids are playing in the park, how to pay park insurance, would the park
have lights, volunteers to mow or hire people to mow. Those present
talked about calling a meeting of the residents and amending the
by-laws, in order to pay the insurance in a timely manner. The Board
took no action. The Board did encourage the group to work toward
resolving the issues.

Park Committee The consensus of the Board was that creating a Park
Committee should be on hold.

Town of Sun Prairie Building Code Ordinance concerning application of

Inspection Service Contract revision The new contract includes the
new design review planning fee and a modified fee schedule, which
includes the mechanical fees so that the Town may go to a one uniform

to sign the contract.

Correspondence The Board received a
letter from Duffy Grain encouraging the Board to do what would be
necessary to open Twin Lane Road. Currently there still is water over
the road.

Vernon Pogue, second by Doug Yelk to adjourn the meeting. Meeting was
declared adjourned at 10:20 p.m.
