Regular Town Board Meeting
The Town Board of the Town of Sun Prairie met on Monday, February 9,
2009, at 7:30 p.m. at the Town Hall, 5556 Twin Lane Road, Marshall, WI.
Call to Order Chairperson Lyle Updike called the meeting to order
at 7:30 p.m. Supervisors Vernon Pogue and Doug Yelk, Clerk Claudia
Quick, Treasurer Cindy Yelk, and Office Assistant JoAnn Ramsfield were
present. Angie White, Sun Prairie Volunteer Fire Department, was
present.
Statement of Public Notice The chair directed that the minutes
show notice of the meeting was published in the February 5, 2009 issue
of The Star. Copies were posted on the three town bulletin boards on
February 6, 2009.
Pledge of Allegiance Doug Yelk led the pledge.
Approve Minutes of Prior Meetings Moved by Vernon Pogue second by
Doug Yelk, to approve the minutes of the January 26, 2009 Town Board
Meeting.

Report on Town Roads: Delivery of the new tractor will be
February 10, 2009. Farrell and Dorshorst have made repairs to the grader
and Wes’s plow truck was into Burke Truck for repairs..
Consider and Take Action re: Preliminary Adoption of Fire Prevention
Code Ordinance. Angie White addressed the importance of adopting a
uniform fire code for the surrounding municipalities. The ordinance
allows for citations and local enforcement of commercial owners in
violation. Angie presented a list of commercial properties that they are
currently inspecting and stated that the codes were reviewed with the
owners. Moved by Doug Yelk, second by Lyle Updike Preliminary Adoption
of the Fire Prevention Code as presented

A Fire Extinguisher training conducted by Sun Prairie Fire Chief will
be held at the Sun Prairie Town Hall for local commercial owners and
their employees. There will be no charge for this training.
Consider Preliminary Adoption of Solid Waste Disposal Ordinance.
Moved by Vern Pogue, second by Doug Yelk Preliminary Adoption of the
Solid Waste Disposal Ordinance with Section 9 – Bond and Revocation of
Permit, first paragraph, amended to read, "A permit under this
ordinance shall not be effective unless there is on file with the town
clerk a cash bond or a bond with a corporate surety duly licensed in the
State of Wisconsin in the penal amount determined by the town board."

Consider Preliminary Adoption of Alcohol Ordinance including demerit
system.
The board explored the options of addressing the three issues at hand
in three separate ordinances or addressing all issues in one ordinance.
The issues are: the business license, disciplinary action of the
operator and/or owner, and hours of sales. After the board reviewed
sample ordinances of other municipalities, Doug Yelk accepted the task
to draft an ordinance for preliminary adoption. When the board is
satisfied with the language of the ordinance a public hearing will be
posted. The license holders will be encouraged to attend the public
hearing so that they are fully informed as to the consequence for
violations.
Consider and Take Action re: EMS Joint Municipal Agreement.
There is nothing new to report. No action was taken.
Consider and Take Action re: EMS Arbitration. There is nothing
new to report. No action was taken.
Discuss Curbside Collection Program and Bid process.
The town five year contract for curbside collection expires December
2009. The clerk will develop a bid packet for trash collection
businesses. Bids will be accepted for typical trash collection and for
automated trash pickup.
Work on Local Hazard Mitigation Plan Worksheets
The hazard mitigation plan worksheets were reviewed and completed by
the board members at the meeting.
Audit and Pay Bills: The Board reviewed the list of invoices for
first half of February. There was a recommendation that the plan
commission secretary per diem be increased. The board would like the
Plan Commission Chair to submit recommendations to the board. Moved by
Vernon Pogue, second by Doug Yelk to pay the bills including the hand
written additions.

Old Business/New Business
The treasurer will have tax settlement on February 20th.
At the same time she will also be paying the County their share of the
dog license fees. Thus far Cindy Yelk has issued four dog kennel and 160
dog license.
The clerk handed out comparison spreadsheet starting at December 1988
through 2008 that addressed Assessment Ration Market Value, Town Mill
Rate, and the three School Districts.
Working Lands Initiative workshops scheduled for February 24 is
designed to provide local officials and interested citizens with an
opportunity to explore tools and strategies to protect working lands in
Wisconsin. Claudia will make reservations for five.
The Town received $75 from the Municipal Court for the parking
tickets issue by the town constable.
