The following members were present:  Chair, Roger Fetterly, Jane Case, Dot Havens, Allen Meyer, John Quimby and Doug Yelk.  Absent: Paul Stang.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on May 9, 2017.

Approval of the minutes of previous meeting:  Minutes of the April 17, 2017 Plan Commission meeting were approved as submitted.

Recess for comments by visitors:  No public comments were presented.

Consider and take action on a preliminary plan by Jeff Zimmerman to rezone 0.9 acres of a 38.22 acre farm parcel from A-1(Ex) Agricultural to R-1 Residential to divide the original farm house from the remainder of the farm to sell to a relative at 4973 Ridge Road in Section 36, Town of Sun Prairie.

Motion by Quimby/Havens to approve the preliminary plan as proposed.  Vote:  5 Ayes, 0 Noes, 1 Absent, 1 Abstention  (Yelk).  Motion carried.

 Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for June 19, 2017 at 7:00 p.m.

Plan Commission Minutes, April 17, 2017

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chair, Roger Fetterly, Jane Case, Dot Havens, Allen Meyer, John Quimby and Paul Stang.  Absent: Doug Yelk.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on April 11, 2017.

Approval of the minutes of previous meeting:  Minutes of the February 20, 2017 Plan Commission meeting were approved as submitted.

Recess for comments by visitors:  No public comments were presented.

Consider and take action on a preliminary plan by Joan Rademacher to rezone 2.25 acres of a 4.74 acre lot (Lot 1 of CSM 9522, date 11/22/99) from RH-2 Rural Homes to RH-1 Rural Homes to divide the original lot into two separate RH-1 lots to offer for sale at Charles Hahn Drive, Section 22, Town of Sun Prairie.

Discussion considered the following information:

  1. The definition of a Certified Survey Map: A recorded division of land into 4 or less lots of less than 15 acres, not a Subdivision.
  2. The definition of a Subdivision is creation of: 5 or more lots of 15 acres each or less in area; or 5 or more lots of 15 acres each or less in area by successive divisions within a 5 year period.
  3. Stats., 236.34(1)(bm): A certified survey map may be used to change the boundaries of lots and outlots within a recorded plat, recorded assessor’s plat under s. 70.27, or a recorded certified survey map if the reconfiguration does not result in a subdivision or violate a local ordinance or resolution.
  4. CSM 9522 is a 4 lot land division of CSM 7432, which was a 4 lot land division created 6/05/90.
  5. Ten residential lots have been created on this 36 acre farm since 1990 without regard to the orderly layout and use of land.
  6. Good land use practices would require that these land divisions comply with State and local subdivision regulations.

The PC needed more information to determine which land division laws were applicable to the proposal.

Motion by Fetterly/Havens to table the proposal to give the applicant time to address the issues raised.   Vote:  3 ayes, 3 noes, 1 absent.  Motion failed.

Motion by Stang/Quimby to approve the proposal as originally submitted.  Vote:  0 Ayes, 6 Noes, 1 Absent.  Proposal failed to get approval.

Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for May 15, 2017 at 7:00 p.m.

Plan Commission Minutes, 2/20/17

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Case, Dot Havens, John Quimby, Paul Stang and Doug Yelk.  Absent: Al Meyer.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on February 14, 2017.

Approval of the minutes of previous meeting:  Minutes of the January 16, 2017 Plan Commission meeting were approved as submitted.

Recess for comments by visitors:  No public comments were presented.

Public Hearing on Crossroads BP Station Petition.  Allow public comment on a request by Ted Gement, owner of the Crossroads BP filling station requesting design review for construction of a new 18,205 ft2, 27 space parking lot on the north side of the filling station at 4711 Highway TT, Town of Sun Prairie.

 

Sixteen neighbors and community members were present.  A Quam Engineering LLC parking lot drawing and Dane County erosion control and stormwater management permits were made available for public viewing.  David Spangler, the resident on the north side of the proposed lot was assured by Dane County Water Resource Engineering Division permit that his 18 inch driveway culver was sufficient to handle the stormwater run-off.  Spangler also raised questions about the proposed retention wall, privacy fencing and invasive lighting from vehicles and security lights.  Owner Gement reassured Spangler that he would work cooperatively to address his concerns.  The fence shall be high enough to screen invasive lighting and vegetation will be provided for screening from CTH N.

Consider and take action on Crossroads BP Petition.  Motion by Quimby/Havens to approve the Crossroads BP request for design review as proposed, including type of construction material, and with the additional requirement that fencing, lighting and tree and shrub screening be addressed to meet the concerns expressed above.  Motion carried.

Public Hearing on Rademacher Rezone Petition.  Allow public comment on petition #2017-11121 by Bruce Rademacher to rezone 2 acres from A-1(Ex) Agricultural to RH-1 Rural Homes adjacent to 4695 Pierceville Road in exchange for rezoning 0.891 acres from R-1 Residential after combining with a 2.695 acres parcel zoned A-1(Ex) Agricultural to create a 3.586 acre A-2(2) Agricultural parcel at 5007 Highway TT, Town of Sun Prairie.

No one appeared to comment on the petition.

Consider and take action on Rademacher Petition.  Motion by Yelk/Stang to approve the petition with a deed restriction that no occupancy permit be approved for a residence on the RH-1 Rural Homes lot until the residence at 5007 CTH TT is removed and that the new A-2(2) Agricultural parcel be deed restricted to no residential development.  Motion carried.

Plan Commission Meeting Minutes, 1/16/17

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following members were present:  Chairman Roger Fetterly, Dot Havens, John Quimby, Paul Stang and Doug Yelk .  Excused: Jane Fiala, Al Meyer.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on January 10, 2017.

Approval of the minutes of previous meeting:  Minutes of the December 19, 2016 Plan Commission meeting were approved as corrected.
Recess for comments by visitors:  No public comments were presented.

Consider and take action on a preliminary plan by Bruce Rademacher to rezone 2 acres from A-1(Ex) Agricultural to RH-1 Rural Homes adjacent to 4695 Pierceville Road in exchange for rezoning 0.891 acres from R-1 Residential to A-2(1) Agricultural at 5007 Highway TT, Town of Sun Prairie.

Motion by Quimby/Havens to approve preliminary plan with a deed restriction prohibiting a residence on the new RH-1 lot while a residence exists on the A-2(1) parcel at 5007 Highway TT.  Additionally a 4 acre conservation easement will need to be identified and recorded to offset the removal of 2 acres from A-1(Ex) zoning.  Motion carried.

Consider and take action on a request by Ted Gement, owner of the Crossroads BP filling station requesting design review for construction of a new 18,205 ft2, 27 space parking lot on the north side of the filling station at 4711 Highway TT, Town of Sun Prairie.

Motion by Yelk/Havens for preliminary approval with the requirement the following be provided for the public hearing on February 20th :  (1) Signed documents from Dane County approving Erosion Control  and Storm Water Management permits;  (2)  Height and type of construction material for retention wall, fencing and screening;  (3)  Type of parking lot lighting;  (4)  Zoning permit, if required by Dane County.  Motion Carried.

Consider and take action on a preliminary plan by Kurt Harry to rezone 0.491 acres (Parcel 191880) from R-1A Residential to A-2(1) Agricultural and combine with Parcel 192150 to adjust the property line between adjacent property owners back to its legal status at 4925 Pierceville Road, Town of Sun Prairie.  Motion by Yelk/Quimby to approve as requested.  Motion carried.

Plan Commission Minutes, November 21, 2016

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Case, Dot Havens, John Quimby and Doug Yelk.  Absent: Alan Meyer, Paul Stang,   Also present:  Town Chairman Lyle Updike.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on November 15, 2016.

Approve the minutes of previous meeting.  Hearing no objections, the October 17, 2016 minutes were approved as submitted.

Public Hearing on Heinemann Petition.  Allow public comment on petition #11051 Heinemann Rentals & Investments LLC, to rezone 0.32 acres of a 34.8 acre parcel from A-1(Ex) Agricultural to C-1 Commercial to bring the area being rezoned into compliance for its existing commercial use at 4587 Highway TT in Section 33, Town of Sun Prairie 

No one appear for public comment

Consider and take action on Heinemann petition.   Motion by Yelk/Quimby to approve petition #11051 with the requirement that any additional paving/impervious surfaces requires prior approval of the Town Board.  Motion carried.

Lyle Updike provided an update on the progress of the Dane County Towns Association (DCTA) committee drafting a zoning ordinance for towns considering withdrawing from Dane County zoning.

Draft 6.1 of the DCTA proposed zoning ordinance was reviewed and discussed in detail.

Proposed changes to the Town’s Comprehensive Plan to conform to Town zoning under the proposed DCTA zoning ordinance were reviewed and discussed in detail.

A proposed Town of Sun Prairie Official Map and a Town Zoning Map required as part of proposed Town zoning ordinance was reviewed.

Motion by Quimby/Yelk to present the proposals in items 7, 8 and 9 above at a public hearing on December 19 where residents will be given the opportunity to comment on those proposals.
