Plan Commission Minutes for November 15, 2004

  1. The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m. by Chairman Roger Fetterly. Members present were: Kennan Crothers, Jennifer Deuster-Loesch, Roger Fetterly, Alan Meyer, Judy Stang, Doug Yelk and Carl Williamson. Also present was Claudia Quick, Town Clerk.
  2. Notice of the meeting was posted on the three town bulletin boards on November 9, 2004 and mailed to members on the same date.
  3. Hearing no objections the minutes of the October 18, 2004 meeting were approved as presented.
  4. Presentation from the public: None.
  5. Kohn preliminary plan. Consider and take action on a preliminary plan by Mike Kohn to rezone approximately 22 acres from A-2 Agriculture to A-B Agriculture Business to grow and sell organic herbs and vegetables and development of a nursery for on-site sales on Pierceville road in section 35, TSP.

    Action on Kohn plan. Motion by Fetterly/Yelk to recommend preliminary approval to rezone no more than 7 acres from A-2 Agriculture to A-B Agriculture Business adjacent to Pierceville Road in section 35, TSP for production and sales of organic farming and nursery products and limit permitted uses to only those authorized under Dane County Ordinance, sections 10.121(2) (b), (d), (e) and (f) as follows: (b) sales distribution, mixing, blending and storage of feeds, seeds and fertilizer; (d) processing and preserving of natural agricultural products, fruits and vegetables; (e) sales, service and repair of lawn and garden equipment; and (f) sales and distribution of nursery stock and plants with a deed restriction prohibiting further residential development. Motion carried 6-1.

  6. Renz preliminary plan. Consider and take action on a preliminary plan by Kelly Renz to rezone 1 acre from R-1 Residential and 4 acres from A-1 Exclusive Agriculture to a 5 acre RH-2 Rural Home parcel to allow keeping up to 5 animal units at 5750 CTH VV, section 14, TSP.

    Action on Renz plan. The LESA analysis of the proposal shows that approximately 3 of the 4 acres proposed for rezoning from A-1 (Ex) to RH-2 is prime farmland and has an LE score in excess of that allowed for rezoning out of A-1 Exclusive agriculture. Motion by Yelk/Stang to table the proposal. Motion carried.

  7. Dollard preliminary plan. Consider and take action on a preliminary plan by John Dollard to rezone a 60 acre farm from A-1 Exclusive Agriculture to two A-2 Agriculture parcels of 28 acres and 32 acres to accommodate the settlement of an estate at 4898 Ridge Road in section 36, TSP.

    Action on Dollard plan. Motion by Stang/Yelk to approve the preliminary plan with a deed restriction on the 32 acres allowing no residential development. Motion carried 4-2.

  8. Election of Plan Commission Secretary. Williamson/Stang nominated Jennifer Deuster-Loesch for a 2-year term as secretary. There were no further nominations. Motion by Fetterly/Yelk to cast a unanimous vote for Jennifer Deuster-Loesch as secretary. Motion carried.
  9. The next regular meeting of the Town of Sun Prairie Plan Commission will be held on December 20, 2004 at 7:00 p.m. at the Town Hall.
  10. The meeting adjourned at 9:15 p.m.

Plan Commission Minutes for September 20, 2004

  1. The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m. by Chairman Roger Fetterly. Members present were: Kennan Crothers, Jennifer Deuster-Loesch, Roger Fetterly, Alan Meyer, Judy Stang, Doug Yelk and Carl Williamson. Also present was Claudia Quick, Town Clerk.
  2. Notice of the meeting was posted on the three town bulletin boards on September 14, 2004 and mailed to members on the same date
  3. Hearing no objections the minutes of the August 16, 2004 meeting were approved as presented.
  4. Presentation from the public: None.
  5. Public hearing on application #9080: The chair opened the public hearing to allow comment on application #9080 by Harold Starks (Representing Ronald Thurston and Robin Olson) to rezone 2.07 acres of a 63 acre parcel from A-1 (Exclusive) agriculture to RH-1 west of 3090 Bailey Road in Section 19, TSP. No one appeared to speak on the proposal. The public hearing was closed.
  6. Action on application #9080: Motion by Williamson/Yelk to forward a recommendation to the Town Board to approve the application with a provision that the driveway turn-a-round comply with the Town driveway ordinance and that a 5-acre conservation easement along the Koshkonong Creek be identified and submitted to the Town Board as part of the application. Motion carried 6-1.
  7. Public Hearing on application #9084: The chair opened the public hearing to allow comment on application #9084 by Koua and Dia Vang to rezone and divide a 2.01 acre lot from RH-l Rural Home into two R-1 Residential lots for new homes east of 2919 Vang Road in Section 31, Town of Sun Prairie.

    Neighbor Joe Bonfield asked for clarification if the cul de sac on the west end of Vang Road would remain. Vang responded that a new easement would be provided to extend Vang Road to the south along the western edge of the the new lots. The public hearing was closed.

  8. Action on application #9084: Motion by Stang/Williamson to forward a recommendation to the Town Board to approve the Vang application. Motion carried 7-0.
  9. Consider and take action on a preliminary plan by Vince and Betty Maly to divide by certified survey map (CSM) 2.75 acres of a 24.8 acre parcel which is currently zoned R-3A Residential into three lots of 40,000 sq. ft. each northwest of the intersection of Bailey Road and Parkview Road in Section 17, TSP.

    Motion by Yelk/Williamson to approve the Maly preliminary plan with a provision that lots 2 and 3 be deed restricted to single family residential lots. Motion carried 6-1.

  10. Consider and take action on a preliminary plan by Ultimate Construction Inc. (Represented by Scott Foley) to rezone 2.95 acres from A-1 (Exclusive) Agriculture to LC-1 Limited Commercial as a storage facility for equipment, material and supplies for an existing construction business at 5230 Pierceville Road in Section 26, TSP.

    Motion by Stang/Yelk to approve the Ultimate Construction preliminary plan with the provision that hours of operation be limited to 6:00 a.m. to 9:00 p.m. and that outside storage be prohibited after December 31, 2004. Motion carried 7-0.

  11. The next regular meeting of the Town of Sun Prairie Plan Commission will be held on October 18, 2004 at 7:00 p.m. at the Town Hall.

Plan Commission Minutes for August 16, 2004

  1. Call to order. The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m. by Chairman Roger Fetterly. Members present were: Roger Fetterly, Alan Meyer, Judy Stang and Doug Yelk. Carl Williamson was excused. Two seats are vacant. Also present was Claudia Quick, Town Clerk.
  2. Public Notice. Notice of the meeting was posted on the three town bulletin boards on August 10, 2004 and an amendment posted on August 12, 2004 and mailed to members on the same dates.
  3. Approve Minutes of the Last Meeting. Hearing no objections, the minutes of the July 19, 2004 meeting were approve.
  4. Presentations from the Public. None.
  5. Public Hearing. To allow public comment on application #9062/1908 by Ben Averill to rezone approximately 0.98 acres from A-1 (Exclusive Agriculture) to R-1 residential and 15.48 acres from A-1 (Exclusive Agriculture) to RH-3 residential to allow use of an existing school and to reconfigure CSM lot lines at 5251 CTH TT in Section 23 and 26, Town of Sun Prairie.
  6. The chair opened the public hearing. Three residents were in attendance. Questions were raised concerning the availability of off-street parking, compliance with the building code in the process of remodeling the existing buildings and child safety issues related to CTH TT adjacent to the property. A building permit and building inspections will address Code compliance, including adequate parking. If highway safety becomes an issue, it would be address by the Dane County Sheriff’s Department. The public hearing was closed.
  7. Action on Averill application. Motion by Fetterly/Yelk to rezone approximately 0.98 acres from A-1 (Exclusive Agriculture) to R-1 residential and 15.48 from A-1 (Exclusive Agriculture) to A-2 Agriculture to allow remodeling and use of the existing school and to reconfigure CSM lot lines at 5251 CTH TT in Section 26, Town of Sun Prairie with the following conditions: 1) A deed restriction that no further development be allowed on the parcel zoned A-2 and the owners of the 15.48 acres be notified of the recommended rezoning. Motion carried: 3 Ayes, 1 nay, 1 absent.
  8. Public Hearing. To allow public comment on application #9040/1905 by the Town of Sun Prairie to rezone 1.0 acre of a 17.6 acre parcel from A-1 (Exclusive Agriculture) to A-2 Commercial to be combined with an existing 1.0 acre C-2 parcel for a Conditional Use permit for governmental purposes (Intent to store salt and equipment) at 5556 Twin Lane Road in Section 13, Town of Sun Prairie.
  9. The Chair opened the public hearing. No one appeared to give public testimony. Public hearing closed.
  10. Action on Town of Sun Prairie application. Motion by Yelk/Stang to approve proposal with an additional recommendation to seek Dane County advice on appropriate zoning for the remaining 16.6 acre parcel. Motion carried: 4 Ayes, 0 Nayes, 1 absent.
  11. Consider and take action on a preliminary plan by “B” Farms, Inc. (Represented by John Blaska) to rezone 5.304 acres of a 40 acre parcel from A-1 (Exclusive Agriculture) to A-2 with a conditional use permit for unlimited livestock as part of a farm consolidation at 2030 Yelk Road, Section 11, Town of Sun Prairie. John Blaska responded to questions concerning transporting cattle feed and disposal of manure. There would be no significant change in the number of cattle kept on the parcel and that a nutrient management plan would remain in effect. Motion by Fetterly/Yelk to give preliminary approval to the “B” Farms proposal. Motion carried.
  12. Consider and take action on an inquiry from Kim Erb seeking clarification on part of a parcel currently spot-zoned B-1 at 2311 CTH T in Section 22, Town of Sun Prairie which has the following recorded deed restriction: “No new buildings are to be constructed in the B-1 zoned area.” Kim Erb wants to expand her business on this site and wanted to know if “No new buildings” excluded additions or if the deed restriction could be amended to allow expansion the business. The consensus of the Plan Commission was a willingness to consider an amendment to the current deed restriction to allow an expansion of the business within the area currently zoned B-1.
  13. Suggested appointments to the Cottage Grove/Sun Prairie Ad Hoc Committee.
