Plan Commission Minutes for June 16, 2014

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Dot Havens, John Quimby, Paul Stang and Doug Yelk.  Absent, excused:  Al Meyer and Jane Fiala.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on June 10, 2014.
  3. Approval of the minutes of previous meeting.  Hearing no objections, May 19, 2014 Plan Commission meeting minutes were approved as submitted.
  4. Recess for comments by visitors:  No public comments were presented.
  5. Public Hearing on petition by Jason Geiger.  Allow public comment on Petition DCPREZ-2014-10703 by Jason Geiger (Agent for James Skalitzky) to rezone 2.365 acres from A-2 Agricultural to C-2 Commercial to create a mini-warehouse business on lot 2 of CSM 9189 at the northeast corner of the intersection of Town Hall Drive and Hwy 19 in Section 3, Town of Sun Prairie.
    James Skalitzky spoke in favor of the petition.  Patrick and Kathryn Petrie, neighbors on the eastern boundary raised questions about screening and the view from their property, storm water runoff, lighting, hours of operation and in-and-out traffic.  Each concern was address and a 5-foot privacy fence on the eastern boundary was suggested which seem to satisfy the Petries.  Other parties expressed similar opinions and concerns.
  6. Consider and take action on Geiger petition.  Motion by Stang/Havens to approve the proposal with an additional requirement that a 5-foot privacy fence be constructed on the eastern boundary of the property at the beginning of construction of the first warehouse unit.  Roll call vote:  Fetterly, Stang, and Havens. Opposed: Quimby and Yelk. Motion carried.
  7. Consider and take action on the design review for the building and site in item 6 above.  Motion by Stang/Yelk to postpone.  Motion carried, 5-0-3.
  8. Public Hearing on petition by Luis Gomez.  Allow public comment on a request by Luis Gomez to rezone a 0.95 acre lot from R-1 Residential to LC-1 Limited Commercial and a conditional use permit to allow caretaker occupancy of the home by the owner and outdoor storage of 2 trucks and 2 enclosed trailers for his drywall contractor equipment at 2545 Kenneth Ct. in Section 32, Town of Sun Prairie.
    Approximately 10 neighbors and interested persons spoke in opposition to the rezone.  Most were concerned about commercial operations and outdoor storage of trucks and trailers in a residential neighborhood.  Speaking against the proposal were Amber Stamsta (owner of the home for sale on the eastern boundary of the Gomez property and who made the complaint to Dane County zoning inspector), Donald Hue, Ernst Conrath, James Raftery, Carl Williamson and others.
  9. Consider and take action on Gomez request.  Motion by Yelk/Stang to deny approval of the Gomez request.  Roll call vote for:  Quimby, Stang and Yelk.  Opposed: Fetterly and Havens.  Motion carried.
  10. Reviewed a conceptual plan proposed by Dennis Midthun and Michael Schuster to reconfigure and add new lots for residential homes, condominiums and a neighborhood park in the Savannah Valley subdivision.
  11. Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for July 21, 2014 at 7:00 p.m.
  12. Adjournment.  The meeting adjourned at 9:25 p.m.

Plan Commission Minutes for May 19, 2014

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Al Meyer and Paul Stang.  Absent, excused: Dot Havens, John Quimby and Doug Yelk.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on May 13, 2014.
  3. Approval of the minutes of previous meeting.  Hearing no objections, April 21, 2014 Plan Commission meeting minutes were approved as submitted.
  4. Recess for comments by visitors:  No public comments were presented.
  5. Consider and take action on a preliminary plan by Jason Geiger.  Petitioner Jason Geiger proposes to rezone 2.365 acres from A-2 Agricultural to C-2 Commercial to create a mini-warehouse business on lot 2 of CSM 9189 and the design review of the facilities at the northeast corner of the intersection of Town Hall Drive and Hwy 19 in Section 3, Town of Sun Prairie.
    Motion by Fetterly/Fiala to approve as proposed.  Motion carried, 4 ayes, 0 noes, 3 absent.
  6. Consider and take action on a preliminary plan by Luis Gomez.  Petitioner Luis Gomez requests approval to rezone a 0.95 acre lot from R-1 Residential to LC-1 Limited Commercial and a conditional use permit to allow outdoor storage for his drywall contractor equipment at 2545 Kenneth Ct. in Section 32, Town of Sun Prairie.
    Motion by Fetterly/Fiala to approve the proposal with the additional provision that only two trucks and two enclosed trailers related to the owner’s drywall business be allowed for outside storage.  Motion carried, 4 ayes, 0 noes, 3 absent.
  7. Reviewed a conceptual plan by Dennis Midthun to reconfigure and add new lots for residential homes, condominiums and a neighborhood park in the Savannah Valley subdivision.
  8. Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for June 16, 2014 at 7:00 p.m.

Plan Commission Minutes for April 21, 2014

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members    were present:  Chairman Roger Fetterly, Dot Havens, Al Meyer, John Quimby and Doug Yelk.  Absent: Jane Fiala, Paul Stang.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on April 16, 2014.
  3. Approval of the minutes of previous meeting.  Hearing no objections, minutes of the March 17, 2014 Plan Commission meeting were approved as submitted.
  4. Recess for comments by visitors:  No public comments were presented.
  5. Public Hearing on Dane County blanket rezoning.  Conduct an informational  briefing and allow Town of Sun Prairie residents and property owners to be heard on a Dane County Planning and Development proposal presented by Kurt Kodl to blanket rezone existing parcels, currently zone A-1(Ex) Agricultural in City of Sun Prairie and Village of Cottage Grove Urban Service Areas, which are no longer in compliance with the State of Wisconsin Farmland Preservation law.Laurie Vanderbloemen and James Mitchell appeared seeking clarifying  information on the proposed rezoning of the Vanderbloemen parcels.  They were satisfied with answers to their questions.  Marvin McCoy, owner of two parcels, was in attendance, but made no comments.
  6. Consider and take action on Dane County proposal.  Motion by Yelk/Quimby to approve the Dane County proposal to blanket rezone 31 existing parcels, currently zone A-1(Ex) Agricultural in City of Sun Prairie and Village of Cottage Grove Urban Service Areas, as shown on attached list and map, which are no longer in compliance with the State of Wisconsin Farmland Preservation law.  Motion carried, 5-0-2.
  7. Consider and take action on a preliminary plan by Jason Geiger.  Petitioner Jason Geiger proposes to rezone 2.365 acres from A-2 Agricultural to C-2 Commercial to create a self-storage business on lot 2 of CSM 9189 at the northeast corner of the intersection of Town Hall Drive and Hwy 19 in Section 3, Town of Sun Prairie.No motion was offered to take action on the proposal.  Plan Commission members expressed a need for a more detailed proposal from the applicant to address stormwater/detention/runoff  issues, lighting, parking, traffic, landscaping, building and design review.  The applicant was asked to address these concerns by providing a more detailed proposal for the next meeting on May 19, 2014.
  8. Reconsider and take action on a petition by David Bauer.  At the request of the Town Board, reconsider petition DCPREZ-2014-10659 by David Bauer to spot rezone 0.083 acres of a 0.92 acre parcel from R-1 Residential to C-2 Commercial to allow parking or storage of the owner’s recreational motorhome weighing in excess of 12,000 lbs. at 4688 Pierceville Road in Section 34, Town of Sun Prairie.The Town Board returned the proposal to the Plan Commission asking to consider other alternatives to creating a C-2 Commercial District.  Review of Dane Co. Ordinance 10.18(8)(e) indicate that parking and storage of vehicles in excess of 12,000 lbs. is only authorized in C-2, EXP-1 and M-1 zoning districts.  Also there are no provisions for a conditional use permit for this purpose.  Of the three zoning districts allowed, C-2 is the most appropriate.

    Motion by Quimby/Havens to approve the petition with the additional limitation that commercial uses of the C-2 area be restricted to parking, inside storage and minor maintenance of the owner’s recreational motorhome which exceeds a gross weight of 12,000 lbs., and prohibit all other commercial uses. Such limitations shall be entered as a deed restriction recorded with the Dane County Register of Deeds. Motion Carried. 5-0-2.

  9. Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for May 19, 2014 at 7:00 p.m.

Plan Commission Minutes for March 17, 2014

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Al Meyer, Paul Stang, John Quimby and Doug Yelk.  Excused:  Dot Havens.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on March 11, 2014.
  3. Approval of the minutes of previous meeting.  Hearing no objections, minutes of the March 17, 2014 Plan Commission meeting were approved as submitted.
  4. Recess for comments by visitors:  No public comments were presented.
  5.     John Blaska, owner of the Oaks Golf Course, adjacent to the property in question, raised concerns about allowing commercial zoning in a residential subdivision which could result in incompatible commercial uses in conflict with existing residential owners.

  6. Consider and take action on Bauer petition.  The Plan Commission addressed the issue of commercial uses conflicting with residential uses by limiting the commercial use to parking and storage of the owner’s recreational motorhome and prohibition of all other commercial uses.

    Motion by Fetterly/Quimby to approve the petition with the additional limitation that the commercial uses of the C-2 area be restricted to parking, inside storage and minor maintenance of the owner’s recreational motorhome, which exceeds a gross weight of 12,000 lbs., and prohibit all other commercial uses.  Motion Carried.  6-0-1.

  7. Public Hearing on request by Dennis Midthun.  Allow public comment on a request by Dennis Midthun to approve a new subdivision sign easement to replace an existing sign easement which is to be vacated at the southeast corner of the intersection of Twin Lane Road and Oaken Vale Road in Savannah Valley subdivision, to bring the sign location into compliance with the Dane County Sign Ordinance, in Section 12, Town of Sun Prairie.

    Savannah Valley residents, Paul Dobbel and Gary Behrens spoke in support of the sign request.

  8. Consider and take action on Midthun request.  Motion by Yelk/Fiala to approve as requested.  Motion carried, 6-0-1.
  9. Curt Kodl from Dane County Planning and Development presented a proposal on the County’s Farmland Preservation Plan to blanket rezone parcels which are inappropriately zoned to satisfy State Law requirements related to Farmland Preservation areas.  The Plan Commission suggested changes to zoning and to add or delete parcels to conform to the Town’s Comprehensive Plan.  Mr. Kodl will revise the list and map to reflect suggested changes and provide the Town with updated documents.  A public hearing will be held on April 21, 2014 to present the proposed changes to the affected property owners.
  10. Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for April 21, 2014 at 7:00 p.m.

Plan Commission Minutes for February 17, 2014

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:05 p.m.  The following members    were present:  Chairman Roger Fetterly, Jane Fiala,  Dot Havens, Paul Stang, John Quimby and Doug Yelk.  Excused:  Al Meyer.

  3. Approval of the minutes of previous meeting.  Hearing no objections, minutes of the December 16, 2014 Plan Commission meeting were approved as submitted.

  5. Consider and take action on a preliminary plan by David Bauer.   Petitioner proposes to spot rezone 0.082 acres of a 0.92 acre parcel from R-1 Residential to C-2 Commercial to allow parking or storage of the owner’s motorhome weighing in excess of 12,000 lbs at 4688 Pierceville Road in Section 34, Town of Sun Prairie.
  6. Motion by Quimby/Fetterly to approve the Bauer preliminary plan.  Motion carried 6-0-1.
  7. Reviewed a map of proposed changes to the Resource Protection Corridors in the Dane County Comprehensive Plan as recommended by the Dane County Comprehensive Plan Steering Committee.  It was suggested that all of the landowners affected by the changes to the Resources Protection Corridors be notified of the proposed changes and that the map showing the proposed changes be posted on the Dane County website.  (These suggestions were relayed to Brian Standing at Dane County Planning & Development.  An information workshop on the topic will be scheduled for some time in March.)
  8. Reviewed minor building design changes to an existing building being converted to a Subway restaurant adjacent to the BP station in Section 33 and modifications to the entry at the Rice Grading Shop on CTH T in Section 20.
  9. Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for March 17, 2014 at 7:00 p.m.
