Town Board Meeting

February 23, 2004

The Town Board of the Town of Sun Prairie met on Monday, February 23, 2004 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, and deputy clerk Joan Rademacher were present. Kennan Crothers and Dave Grady also attended the meeting.

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the February 19, 2004 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the three town bulletin boards on February 20, 2004.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the January 26 and February 9, 2004 meetings as presented. Motion carried

Consider and Take Action re: Petition #8888 by Grady Living Trust to change the zoning from A-1 Ex Ag to R-1A Residential on property located southwest of 4827 Pierceville Road, section 35 Doug Yelk spoke on the plan commission’s action report. There was a strong recommendation that the remainder of the 63.5 acres be placed under a Conservation Easement Agreement with the Town, however; the plan commission needs to develop a more detailed policy before implementing conservation easements in the Town. Dave Grady stated he would rather have a deed restriction on his property than a conservation easement. Moved by Doug Yelk, second by Vernon Pogue to approve petition #8888 to change the zoning from A-1 Ex Ag to R-1A residential on property located southwest of 4827 Pierceville Road with the inclusion of a deed restriction on approximately 62.2 acres located on the south side of Pierceville Road to have no further residential development. Motion carried.

Consider and Take Action re: Petition #8904 by Kennan Crothers (agent for Terrance Kruser) to change the zoning from RH-2 Rural Homes to R-1A Residential on property located at 6051 Keller Drive, section 10 Doug Yelk spoke on the plan commission’s action report. Moved by Doug Yelk, second by Vernon Pogue to approve Petition #8904 to change the zoning from RH-2 rural homes to R-1A residential. Motion carried. Moved by Doug Yelk, second by Vernon Pogue to reconsider motion. Motion carried. Moved by Doug Yelk, second by Vernon Pogue to approve Petition #8904 to change the zoning from RH-2 rural homes to R-1A residential with the condition of the signing of a developer’s agreement. Motion carried.

Consider and Take Action re: Petition #8906 by Kennan Crothers to change the zoning from RH-2 Rural Homes to R-1 Residential on property located at 6057 Keller Drive, section 10 Doug Yelk spoke on the plan commission’s action report. Moved by Doug Yelk, second by Vernon Pogue to approve Petition #8906 to change the zoning from RH-2 rural homes to R-1, and grant a variance to the town subdivision ordinance regarding minimum lot width from 150 feet to 118 feet on lots 2, 3, and 4. Motion carried.

Consider and Take Action re: Operator License request Moved by Vernon Pogue, second by Doug Yelk to approve the operator licenses for Jason J. Meerdink and Matthew Reel. Motion carried.

Consider and Adopt policy re: Replacement of Mailboxes Clerk Claudia Quick presented a mailbox replacement policy. After review and discussion it was moved by Lyle Updike, second by Vernon Pogue to approve the mailbox replacement policy with the following changes: 1. Section D to change from three months to four months, and

2. Section E - The Town shall deliver etc. Motion carried.

Audit and Pay Bills Moved by Lyle Updike, second by Vernon Pogue to approve the bills as presented. Motion carried.
