Town Board Meeting

March 8, 2004

The Town Board of the Town of Sun Prairie met on Monday, March 8, 2004 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick and deputy clerk Joan Rademacher were present. Kennan Crothers and Phil Frei were also present.

Pledge of Allegiance

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the March 4, 2004 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the three town bulletin boards on March 5, 2004.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes from the February 23, 2004 meeting as presented. Motion carried.

Report on Town Roads No report.

Consider and Take Action re: Request by P. Frei for Vacation of portion of Hidden Meadows cul-de-sac Phil Frei explained that when he purchased his home he did not know that the detached garage was in violation of the Dane County Zoning Ordinance because of location requirements. He asked if the board would consider vacating a portion of Hidden Meadows cul-de-sac to allow his garage to remain in its present location. After discussion the board asked P. Frei to have a new CSM drawn taking into account the new setbacks. This request was tabled until the CSM can be presented at a future meeting.

Re-Consider and Take Action re: Petition #8904 Crothers/Kruser including requiring road construction Kennan Crothers reported that this petition was postponed at the Dane County ZNR Committee meeting because of an issue concerning whether the lots in question should be submitted as a CSM or a plat. Norbert Scribner, plat review officer, will have a decision by the March 9, 2004 ZNR work meeting. This petition does require a developer’s agreement that will cover road construction. The developer’s agreement will be addressed at a future meeting.

Re-Consider and Take Action re: Petition #8906 Crothers regarding lot widths and zoning districts Moved by Doug Yelk, second by Vernon Pogue to take action on petition #8906 correcting variance on lots 2, 3 and 4 regarding the minimum lot width at building line from 150 feet to 100 feet. Motion carried.

Re-Consider and Take Action re: Petition #8879 Benesh concerning conditions of approval Moved by Doug Yelk, second by Vernon Pogue approve petition #8879 with the following conditions:

  1. No residential development allowed;
  2. No utility services as defined in Chapter 10, Dane County Ordinances;
  3. Limit one animal unit per acre.

Motion carried.

Consider and Take Action re: Policy or Ordinance Amendment regarding Expectation that Plan Commission Members attend Plan Commission Monthly Meetings Moved by Doug Yelk, second by Vernon Pogue to create an ordinance amendment to Ordinance No 77 – 1, An Ordinance to Create a Plan Commission for the Town of Sun Prairie, Dane County, Wisconsin. This amendment to be listed under Section Two, sub (c) to read as follows: Three absences in a twelve month period by a member of the commission from regularly scheduled meetings shall operate to vacate the members office. An absence excused by the Commission Chairperson for good cause shall not be considered an absence hereunder. Motion carried.

Audit and Pay Bills Moved by Vernon Pogue, second by Doug Yelk to approve the bills as amended with the amended bills being Hazelbaker & Associates in amount of $625.00 and Crispell-Snyder, Inc. in amount of $1,248.25. Motion carried.

Town of Bristol will be billed for 50% of the costs of Hazelbaker & Associates invoice for February 19 meeting plus 50% of the invoice for the February 9 joint meeting; and 50% of Crispell-Snyder, Inc. invoice.
