Town Board Meeting

April 12, 2004

The Town Board of the Town of Sun Prairie met on Monday, April 12, 2004 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, deputy clerk Joan Rademacher and highway patrolman Dennis Farrell were present. Five other people were in attendance.

Pledge of Allegiance The Pledge of Allegiance was led by Claudia Quick

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the April 8, 2004 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the three town bulletin boards on April 9, 2004.

Approve Minutes of Previous Meetings Moved by Vernon Pogue, second by Doug Yelk to approve the minutes from the March 22, 2004 and April 8, 2004 meetings as presented. Motion carried.

Presentation from the Public None.

Report on Town Roads Dennis Farrell gave a short report. Moved by Lyle Updike, second by Doug Yelk to put bids out for seal coating, blacktop and a salt shed. Motion carried. There was discussion on the fact that the Town needs to have more land re-zoned for a salt shed. The clerk, Claudia Quick will check into the correct zoning and CUP information. Moved by Lyle Updike, second by Vernon Pogue that we proceed with the rezone and CUP for an appropriate area for a salt shed. Motion carried.

Consider and Take Action re: D. Huston plans for former LaRue commercial property Dan Birrenkott of Birrenkott Surveying presented the LaRue Fields plat. D. Huston may be purchasing this property and there were two options discussed. One is to go with the plat as is or to have one large parcel. The preliminary plat has been approved and they need to keep moving on this, as deadlines on the final plat must be met. Mr. Birrenkott will remain in contact with the Town.

Take Action re: Zoning and setback violations at 2864 Bailey Road, M. Bursaw Mark Bursaw was reminded by the Board of the January 12, 2004 meeting which outlined what was allowed in a residential area. The issues of having only one work vehicle stored outside, no commercial activity allowed, 2nd driveway not impede the flow of water and no obstructions in the right-of-way were discussed. Bursaw was told to meet with Dennis Farrell to resolve these issues. Moved by Lyle Updike, second by Vernon Pogue to request a report from Dennis Farrell after the above-mentioned issues are addressed and if the obstructions in the right-of-way are not removed immediately they will be removed by the Town and M. Bursaw will be billed. Motion carried.

Consider and Take Action re: Request by F. Miller for road vacation, lot 3, JB Farm Road Dan Birrenkott explained that the deck on a home built by F. Miller encroaches on the right-of-way 1 foot by 3 feet. Moved by Doug Yelk, second by Lyle Updike to approve the request for road vacation as presented, this being an area of 9.7 sq. ft. with all fees to be paid by the petitioner. Motion carried.

Consider Preliminary Plat by K. Crothers; section 10 In order for the land divisions to take place the CSM’s that were approved by the Town Board must now be a plat. Moved by Doug Yelk, second by Vernon Pogue to approve the preliminary plat as presented. Motion carried. Moved by Doug Yelk, second by Vernon Pogue to grant a variance on lots 2, 3, and 4 that the minimum lot width at the building line is at a minimum of 100 feet. Motion carried.

Take Action re: Zoning Petition #8832 – Otto as amended by the Board Moved by Doug Yelk, second by Vernon Pogue to approve petition #8832 as amended. Motion carried.

Take Action re: Zoning Petition #8904 and #8906 – Crothers as amended by the Board Moved by Doug Yelk, second by Vernon Pogue to approve petitions #8904 and #8906 as amended. Motion carried.

Consider Final Adoption of Amendment to Town Plan Commission Ordinance re: Meeting Attendance Moved by Doug Yelk, second by Vernon Pogue to approve the adoption of amendment to Town Plan Commission Ordinance #77-1. Motion carried. This amendment to be listed under Section Two, sub(c) to read as follows: Three absences in a 12-month period by a member of the commission, from regularly scheduled meetings, shall operate to vacate the member’s office. An absence excused by the commission chairperson for good cause shall not be considered an absence hereunder.

Audit 2003 Accounting Books of Clerk and Treasurer The books of the Clerk and Treasurer were presented for consideration and audit. Moved by Lyle Updike, second by Doug Yelk to accept the books of the clerk, and the books of the treasurer as amended. Motion carried. The board members signed each book, acknowledging the audit and balancing of the books.

Consider Request by J. Rademacher to reduce work hours Treasurer, Joan Rademacher asked if her hours could be reduced from 30 to 24 hours per week. Moved by Lyle Updike, second by Vernon Pogue to adjust the hours from 30 to 24 with a proportional adjustment to be taken out of office assistant salary. Motion carried.

Consider and Take Action re: Operator License Applications Moved by Vernon Pogue, second by Doug Yelk to approve operator licenses for Dana Graffin and Jennifer Weaver. Motion carried.

Audit and Pay Bills Moved by Vernon Pogue, second by Doug Yelk to pay the bills as presented with the additions listed. Motion carried.

Old Business/New Business

Correspondence Clerk Quick stated that annexation papers were dropped off today for Young, Dick and Curran properties located on Town Hall Drive near Schuster Road. Also, Paul Larson from the City of Sun Prairie planning department asked for Board comments on the ARG Matey annexation located northwest of Schuster Road and Town Hall Drive.

Set Next Meeting Date/Adjournment The next meeting date was set for Monday, April 26, 2004 at 7:30 P.M. Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 10:25 p.m.
