Public Hearing and Town Board Meeting

May 12, 2003

The Town Board of the Town of Sun Prairie met on Monday, May 12, 2003 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, deputy clerk Joan Rademacher and Dennis Farrell highway patrolman were present. One additional person attended the meeting.

Statement of Public Notice The chair directed that the minutes show that notice of the May 12, 2003 Town Board meeting was published in the May 8, 2003 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the two town bulletin boards and temporarily at Buckshot’s Hwy. N on May 9, 2003.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the April 28, 2003 meeting. Motion carried.

Report on Town Roads Dennis Farrell reported on the following:

  1. Consider and Take Action re: Status of 1986 Plow Truck Various proposals were presented for the board’s consideration. After discussion is was moved by Lyle Updike, second by Doug Yelk that we dispose of the 1986 plow truck for $6,000 or best offer. Motion carried.
  2. The final layer of blacktop has been applied to Manley Drive and Savannah Valley subdivision. Shouldering has also been completed. The workmanship is being overseen and will not be accepted until the Town Hwy. Dept. gives their approval.
  3. Savannah Valley has drainage problems in the outlot area. Dennis Farrell has talked to Bill Biesman of Vierbicher and Associates and they are aware of the problem. He will also be contacting F. C. Raemisch & Sons as they did the work.
  4. The State hygiene lab has tested our well water and the results came back negative on bacteria and metals. Jeff Wilcox (U.W. student) did a study of the water table in the area and we will contact him to see if he would do further testing.

Consider Preliminary Plans by K. Miller for LC-1 Zoning, Norton Road, section 31.

Fred Miller spoke on behalf of this plan. He stated his son stores construction equipment in the building and it is used in an excavating and landscaping business. Discussion followed on the shed not being built to commercial standards and concern about the impact on Norton Road. Consensus of the board was that if he chooses to proceed he would know the reservations the board has.

 

*Public Hearing – Adopt Amendment to Town Enforcement of Code and Deposit Schedule Ordinance. Chairman Updike opened the public hearing. Dennis Farrell reported on weight limit information he received on enforcement from the Dane County Sheriff’s Dept. and State Patrol. The weight limit ordinance must be enforced according to State Statutes. Dennis Farrell will be meeting with the State Patrol this week and will report back to the board. The chair closed the public hearing. Moved by Lyle Updike, second by Vernon Pogue to adopt the amendments to Town Enforcement of Code and Deposit Schedule Ordinance. The 1st amendment adds the following, "Enforcement agency contracted by Town"; the 2nd amendment is added to 89-1 to have a "1% interest charge per month and a .5% penalty charge per month on delinquent personal property taxes". Motion carried.

Consider and Take Action re: Enforcement of Weight Limit Ordinance Dennis Farrell reported on the deteriorated condition of Bedner Road due to excessive weight hauled in.

Lyle Updike met with Mayor Hannemann, city attorney Paul Evert and Pat Cannon to discuss the weight limit ordinance adopted by the Town. The following items were discussed and the City understood the following.

  1. Municipal vehicles may use Bailey Road, regardless of their weight, if they are going to the Wastewater Plant and any vehicle making a delivery to the Wastewater Plant may use Bailey Road.
  2. Emergency vehicles are always permitted to use the posted roads.
  3. Delivery vehicles to reach current and future residential developments that take access off of Town Hall Drive may use Town Hall Drive, north of Hwy.19.

Clerk Claudia Quick will write a letter agreeing to points 1 and 2. The Town will not post or enforce the Weight Limit Ordinance on Town Hall Drive north of Hwy. 19 until the issues of extending the road agreement are addressed. If the City agrees to extend the road agreement the Town would not enforce the weight limit for the duration of the agreement. The Town offers July 1 as a deadline for agreement.

No action taken at this time.

Consider and Take Action re: Revised Driveway Permit Standard Operating Procedure. The purpose of this revision is to inspect all driveways whether access is off of a Town, County or State Road. After discussion, moved by Doug Yelk, second by Vernon Pogue to approve the revised driveway permit standard operating procedure with the following amendment, "field access off of a State/County road is obtained from the State/County". Motion carried.

Consider and Take Action re: Application for Operator License. Moved by Vernon Pogue, second by Doug Yelk to approve an operator license for Toni Sieg. Motion carried.

 

 

 

Audit and Pay Bills The Board reviewed the invoice listing. Moved by Doug Yelk, second by Lyle Updike to approve payment of bills as listed including the additions. Motion carried.

Set Next Meeting Date/Adjournment The next meeting date was set for Wednesday, May 28, 2003 at 7:30 P.M. Moved by Lyle Updike, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 10:30 P.M.
