Public Hearing and Town Board Meeting

August 25, 2003

The Town Board of the Town of Sun Prairie met on Monday, August 25, 2003 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road, Marshall, Wisconsin.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, deputy clerk Joan Rademacher and Dennis Farrell highway patrolman were present. Eight additional people attended the meeting.

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the August 20, 2003 issue of The Star. Copies were posted on the three town bulletin boards on August 22, 2003.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the August 11, 2003 meeting. Motion carried.

Public Hearing – Consider and Take Action re: Zoning Petition #8767 by D. & C. Hoagland to change the zoning from A-1 Ex Ag to A-2(4) Agriculture The Chairman opened the public hearing. David Hoagland presented his petition stating that he would like the correct zoning for his property and to have a conditional use permit for his limited family business of auto repair. He further stated that he mainly works on his own vehicles and does a few side jobs. He also presented a list of people who did not object to his rezone. One person spoke in favor of the petition. Various residents spoke against the petition stating the following concerns: flooding/run off, other businesses coming to the area, land values decreasing, oil etc. contaminating the land, vehicles setting outside, possible expansion of the business and that this land is in a residential area. David Hoagland responded to these concerns. The chairman closed the public hearing. After discussion it was moved by Doug Yelk, second by Vernon Pogue to deny petition #8767. Motion carried.

a. Consider and Take Action re: Conditional Use Permit for Limited Family Business – Auto Repair Unnecessary to act on this as the above petition was denied.

Consider Preliminary Plans by C. Otto to separate homestead from farm, section 19 Chuck Otto informed the board of his plan to separate the existing homestead including approximately 2 acres from the farm. The Board informed him of the moratorium which is in affect until the comprehensive plan is adopted. The consensus of the Board was that he should wait until the moratorium is lifted and then he could proceed.

Consider Erosion and Drainage Control Letter of Credit, Savannah Valley Clerk Claudia Quick explained that this letter of credit covers erosion and drainage control while public improvements/roads are being constructed. As the roads have been constructed the consensus of the Board is to take no action and let the letter of credit lapse.

Consider Application for Operator License Moved by Doug Yelk, second by Vernon Pogue to approve the operator license for Amber Worden. Motion carried.

Consider and Adopt Resolution setting fees for Town Moved by Vernon Pogue, second by Doug Yelk to adopt the resolution for fees as it currently stands. Motion carried. The resolution will be signed at the next board meeting.

Audit and Pay Bills The Board reviewed the invoice listing including the additional bills listed. Moved by Vernon Pogue, second by Doug Yelk to approve payment of bills as listed. Motion carried. Clerk Quick reported that the Town is holding in escrow, funds for erosion control on the Bomkamp Circle development. The Board by unanimous consent agreed to return the escrowed amount of $800.00.

Set Next Meeting Date/Adjournment The next meeting date was set for Monday, September 8, 2003 at 7:30 P.M. Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 11:15 P.M.
