The Town Board of the Town of Sun Prairie met on Monday, January 13, 2003 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, and deputy clerk Joan Rademacher were present. Ten additional people attended the meeting.

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the January 9, 2003 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the two town bulletin boards and temporarily at Buckshot’s Hwy. N on January 10, 2003.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the December 9, 2002 meeting. Motion carried.

Presentation from the Public John Blaska commented on the savings the Town was realizing due to the lack of snow.

Report on Town Roads None.

*Public Hearing – Consider Conditional Use Permit #1808 by Koua Vang for Community Living Arrangement for nine or more persons for property located at 2910 Vang Road, section 31. The Chairman opened the public hearing. Koua Vang reported on his proposal for the CBRF (Community Based Residential Facility) for 9 or more. He has 6,000 sq. ft of living space. He stated that due to the cost of installing a sprinkler system and other handicap accessible upgrades he needs to have more residents. He met with the clerk, Claudia Quick and highway patrolman Dennis Farrell to discuss the parking requirements. He passed out a map showing the off-road parking spaces needed to fulfill the requirements of Dane County Zoning. Residents inquired as to the location of the facility and if the septic system would be adequate. Chairman Updike replied that the licensing agency would check for compliance and the Public Health Dept. would also be involved. The Chairman closed the public hearing.

Moved by Doug Yelk, second by Vernon Pogue to approve C.U.P #1808 with the addition of the parking spaces as shown on the submitted map. Motion carried.

Consider and Take Action re: Zoning Petition #8575 as amended by the Town Board. After a lengthy discussion it was moved by Vernon Pogue, second by Doug Yelk to approve Petition #8575 as amended by the Town.

Consider and Take Action re: City denial of approval of Drunasky CSM The Town Board, Town Attorney Mark Hazelbaker, Plan Commission Chairman Roger Fetterly, Stephen and Maureen Drunasky, and Clerk Claudia Quick discussed the City’s denial of the Drunasky CSM. Following discussion it was moved by Lyle Updike, second by Vernon Pogue to have the Town Attorney file claim against the City of Sun Prairie regarding their action against the Drunasky petition. Motion carried.

Consider and Take Action re: Amendment to County Chapter 10 Zoning Ordinance to include amendment #16 pertaining to recycling of concrete and asphalt as part of mineral extraction operations. The Board will defer action until the response from Dane County Towns Association is received.

Audit and Pay Bills The Board reviewed the invoice listing. Moved by Vernon Pogue, second by Doug Yelk to approve payment of bills with the additional bills listed. Motion carried.

• Clerk Claudia Quick passed out the Statement of Taxes for 2002.
• Jeff Zimmerman needs to proceed with a rezone and CSM. He will bring preliminary plans to the next board meeting and apply under a variance listed for the Moratorium on Land Divisions.
• Chairman Lyle Updike attended the EMS meeting. Vernon Pogue was unable to attend due to surgery. Lyle reported there was discussion about contracting with a company to do the billing. The meeting also went into closed session.
• January 9, 2003 Chairman Updike attended the Fire Commission Meeting. Discussion on cost splits between entities will be pursued at the next meeting.
• Clerk Claudia Quick reported that we are receiving bills from Wingra Stone Co. in regards to Twin Lane Road and that Dennis Farrell is working with F. C. Raemisch to determine what should be charged to the Town. As long as no charges are applied to the bill the board will wait for some solution to occur.
• Robert Quick has been solving computer problems throughout the year. He should submit a bill for service during 2002 and establish a contract for service with an hourly rate for 2003. This contract could be paid quarterly.

Correspondence

• The Town Board received a letter from Lenore and Fred Loewen stating their concerns with land use changes in the Town and the increase in taxes.
• Received a memo from Chris James, Dane County Park Planner regarding a meeting to be held on January 22, at 7:00 p.m. in the Community Room of the Sun Prairie City Hall for the Patrick Marsh Study Area Landowners.
• Charter Communications informed the Town of Sun Prairie of the new prices that will become effective February 15, 2003.

Set Next Meetng Date/Adjournment The next meeting date was set for Monday, January 27, 2003 at 7:30 P.M. Moved by Doug Yelk, second by Lyle Updike to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 10:30 p.m.
