The Town Board of the Town of Sun Prairie met on Monday, October 11, 2004 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, deputy clerk Joan Rademacher and highway patrolman Dennis Farrell were present. Gary Hebl also attended the meeting.

Pledge of Allegiance The Pledge of Allegiance was led by Gary Hebl.

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the October 7, 2004 issue of The Star. Copies were also posted on the three town bulletin boards on October 8, 2004.

Approve Minutes of Previous Meetings Vernon Pogue asked that a point of clarification be made on the minutes from the September 27, 2004 meeting regarding the presentation by J. Wagner & J. Blaska regarding 2^nd access to lot on Glen Oaks. Point of clarification is as follows; "after discussion regarding the small lot size approved by the Town Board and the setback from Koshkonong Creek required by the Dept. of Natural Resources, it was moved by Doug Yelk, second by Vernon Pogue to grant a variance for a 2^nd driveway at 2264 Glen Oaks Circle." Moved by Vernon Pogue, second by Doug Yelk to approve the minutes from the September 27, 2004 meeting with the addition stated. Motion carried.

Presentation from the Public Gary Hebl addressed the Board regarding his bid for election to the State Assembly 46 District.

Report on Town Roads

1. John Belken, Belken Engineering, and Dennis Farrell observed the 2^nd proof rolling done October 11 at LaRue Fields. Huston would like to pave the road. The road will again be proof-rolled and it will be Belken’s decision on whether the road can be paved or not.
2. Salt shed is completed and 370 tons of salt is delivered.
3. Brush and yard waste collection site is also completed.
4. Trees and brush that need to be cut and/or trimmed have been marked and will be removed starting this week.
5. Dennis Farrell is working on highway budget for 2005.

Receive Request for Resolution to Vacate Portion on JB Farm Road and Hidden Meadows Roads Received the request from Phil Frei to vacate a portion of Hidden Meadows Road. Papers not received for vacation of portion JB Farm Road at this time.

Take action re: Road Vacations, set appropriate dates for Public Hearing Lyle Updike will sponsor the resolution. It was moved by Lyle Updike, second by Doug Yelk to approve the adoption of the resolution to vacate a portion of Hidden Meadows Road with the public hearing to be held at the Town Board meeting on December 13, 2004. Motion carried.

Consider and Take Action to create a Capital Reserve and Contingency Fund for the Sun Prairie Volunteer Fire Department Moved by Vernon Pogue, second by Doug Yelk to adopt a resolution creating a Capital Reserve and Contingency Fund for the Sun Prairie Volunteer Fire Department. Motion carried.

Consider and Take Action re: Operator License Application Moved by Doug Yelk, second by Vernon Pogue to approve an operator license for Jason Manke. Motion carried.

Consider and Tentatively Adopt Municipal Court Ordinance Moved by Lyle Updike, second by Doug Yelk to tentatively adopt the Municipal Court Ordinance. Motion carried.

Audit and Pay Bills Moved by Vernon Pogue, second by Doug Yelk to approve the payment of bills as presented with the additions listed. Motion carried.

Clerk Report

• LaRue Fields Report – have received the letter of credit but not a signed developer’s agreement.
• East End Report – the developer’s agreement has been signed and letter of credit received.
• Discuss Town Welcome road signs – Claudia Quick visited with Lange Enterprises at the Towns Convention in Appleton and we received some layouts and pricing of signs. Consensus of the Board was to defer this issue to the Town electors meeting to be held on November 22, 2004.

Old Business/New Business

• Fire Unit Report - Lyle Updike reported he met with the fire advisory unit and a budget was tentatively approved. This will be discussed in detail at the budget meetings.
• Colonial Club Advisory Group – Lyle stated that a representative from the Colonial Club would attend the budget hearing.

• Clerk reported that the Wisconsin Department of Administration had sent the final estimate of January 1, 2004 population which is 2,345.
• City of Sun Prairie approved the CSM for Blair Moldenhauer.
• There will be an article in The Star reporting the extended voting hours at the Town. They are Monday through Friday, October 25 to 29 the office will be open until 5:30 p.m. Tuesday, October 26, 7:00 p.m. to 9:00 p.m. and Saturday, October 30, 9:00 a.m. to noon.
• Pete Conrad, County Zoning Administrator commented on petition #9080.

Set Next Meeting Date/Adjournment The next meeting date was set for Monday, October 25, 2004 at 7:30 P.M. Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 9:45 p.m.
