Regular Town Board Meeting

October 22, 2002

 

The Town Board of the Town of Sun Prairie met on Tuesday October 22, 2002 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.

Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick, deputy clerk Joan Rademacher and Highway Patrolman Dennis Farrell were present. Three additional people attended the meeting.

Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the October 17, 2002 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the two town bulletin boards and temporarily at Buckshot’s Hwy. N on October 18, 2002.

Approve Minutes of Previous Meeting Moved by Vernon Pogue, second by Doug Yelk to approve the minutes as amended of the October 7, 2002 meeting. Motion carried.

Presentation from the Public

  1. Monte Couch asked why he couldn’t bring something up even if it is on the agenda. Chairman Updike explained that if an item of interest is on the agenda that is the time for discussion.
  2. Steve Drunasky is concerned about his petition to rezone. The City of Sun Prairie informed him that the Town was opposed to his proposal. He was under the impression that the Town had approved his petition. The board explained that they had no objections to his proposal at the time he submitted preliminary plans on August 19 and that he should proceed with application at the County and City.

Consider and Take Action re: Repeal of Ordinance 59-1 Firearm Ordinance The Board felt this ordinance was out of date. Moved by Doug Yelk, second by Vernon Pogue to repeal Ordinance 59-1. Motion carried.

Consider Zoning Petition #8450 for Woldt/Schworck as amended by the County Board Moved by Vernon Pogue, second by Doug Yelk to approve zoning petition #8450 as amended by the County Board. Motion Carried.

Consider and Take Action re: Intergovernmental Agreement and Modifications to the contract for Fire Services Lyle Updike presented the Contract for Fire Protection to the Board. He explained that the changes made were for clarification and that the concept was the same. After review the consensus of the board was to have Lyle Updike sign the formal agreement at the November 4th joint meeting with Fire Department, Towns and City. Lyle also presented a copy of the Intergovernmental Agreement between the City of Sun Prairie, Town of Burke, Town of Bristol and the Town of Sun Prairie. The board reviewed the changes made to the document. Moved by Lyle Updike, second by Vernon Pogue to tentatively approve the Contract for Fire Protection and the Intergovernmental Agreement between the Towns and City. Motion carried.

Vernon Pogue and Doug Yelk wanted to have on record that they were very pleased with the job that Lyle Updike did in working with the Fire Department, Towns and City to complete these agreements.

Consider granting Operator License for L. Millard Moved by Doug Yelk, second by Vernon Pogue to approve the issuance of the operator license upon receipt of the class certificate. Motion carried.

Consider granting Operator License for J. Haensgen Moved by Doug Yelk, second by Vernon Pogue to approve the issuance of the operator license upon receipt of the class certificate. Motion carried.

Review and Tentatively Adopt Ordinances assigning the duties for elected Clerk and Treasurer Lyle Updike explained State Statutes now state that no elected official can make more than $5,000 in another position with the Town. After seeking legal counsel the board was advised that changes should to be made with this next election. In order to hire an appointed clerk and treasurer position the town board would have to have a referendum. The time to have a referendum was missed so the Town will continue with elected positions for clerk and treasurer. The board will establish ordinances outlining the duties and responsibilities of the clerk and treasurer.

The board reviewed Town Clerk Ordinance. The consensus was to maintain current scope of duties of clerk and office manager.

The board reviewed Town Treasurer Ordinance. The board asked that the clerk seek legal counsel from the Town attorney and Wisconsin Towns Association on this ordinance to ask if the board has the ability to assign duties.

Monte Couch presented an opinion on what the ordinances should entail. Various issues will be discussed at budget meeting and the board will develop a proposal to bring to the electors.

Moved by Lyle Updike, second by Vernon Pogue to tentatively adopt the Town Clerk Ordinance replacing Section 4 and Section 5 in current draft to a general Statute reference and delete Section F. To tentatively adopt the Town Treasurer Ordinance replacing Section 4 to a general Statute reference and create Section 5 that states Treasurer will assist Clerk in duties as assigned and limit that assistance to no more than 1040 hours per year. Request Town Attorney and Wis. Towns Association to review the draft ordinance of Treasurer and ask for specific reference if other duties is appropriate. Motion carried.

Establish Policy and Procedure for Various Fiscal Accounts After reviewing the Escrow Funds Policy/Standard Operating Procedure the board added #6 under Section C to provide monthly notification of any activity in fund. Moved by Vernon Pogue, second by Doug Yelk to approve the Escrow Funds Policy with the addition of #6. Motion carried.

Audit and Pay Bills Moved by Vernon Pogue, second by Doug Yelk to pay the bills as presented with the addition of $1,063.11 from Dennis Farrell’s menu fund. Motion carried.

Work session for 2003 Budget Due to the lateness of the hour the board decided not to have a work session.

Set Next Meeting Date/Adjournment The next meeting date was set for Monday, November 11, 2002 at 7:30 P.M. Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 11:20 P.M.
