Town Board Meeting
October 25, 2004
The Town Board of the Town of Sun Prairie met on Monday, October 25, 2004 at 7:30 P.M. at the Town Hall, 5556 Twin Lane Road.
Call to Order The meeting was called to order at 7:30 P.M. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk, clerk Claudia Quick and deputy clerk Joan Rademacher were present. Vince and Betty Maly and John Blaska also attended the meeting.
Pledge of Allegiance The Pledge of Allegiance was led by Claudia Quick.
Statement of Public Notice The chair directed that the minutes show that notice of the Town Board meeting was published in the October 21, 2004 issue of The Star. The agenda was also faxed to the Capital Times. Copies were posted on the three town bulletin boards on October 22, 2004.
Approve Minutes of Previous Meetings Moved by Vernon Pogue, second by Doug Yelk to approve the minutes from the October 11, 2004 meeting. Motion carried.

Consider and Take Action re: CSM creating residential lots by V. Maly, section 17
Vince Maly presented his plan. Doug Yelk commented that these lots were created by CSM and did not require a rezone. He further stated that the Plan Commission recommended approval with request that lots 2 & 3 are SFR and it is in the Town planned growth area. Moved by Doug Yelk, second by Vernon Pogue to approve the CSM for Vince Maly, section 17 creating lots 2, 3, and 4 with a notation on lots 2 & 3 to be single family residence (SFR) and to also add the neighboring use language which states that, "as owner of the lots on this certified survey map, I hereby stipulate that I and my heirs or assigns will not object to any of the legally permitted uses that occur on the adjoining property". Motion carried.
Allow Public Comment, Consider and Take Action re: Rezone Petition #9101 and Conditional Use Permit request by "B" Farms to change the zoning from A-1 Ex Ag to A-2 (4) Agricultural and also allow unlimited livestock on 5 acres of property located at 2030 Yelk Road, section 11 Doug Yelk reported the Plan Commission recommends approval of this petition. Moved by Vernon Pogue, second by Doug Yelk to approve rezone petition #9101 for "B" Farms to change the zoning from A-1 Ex Ag to A-2 (4) Agricultural. Motion carried. Moved by Doug Yelk, second by Vernon Pogue to approve conditional use permit #1922 to allow unlimited livestock on 5 acres of property located at 2030 Yelk Road, section 11. Motion carried.
Consider and Take Action re: CSM for "B" Farms Moved by Doug Yelk, second by Vernon Pogue to approve the CSM for "B" Farms with the addition of the neighboring use language. Motion carried.
Receive Request for Resolution to Vacate Portion of JB Farm Road Moved by Doug Yelk, second by Vernon Pogue acknowledging receipt of the request for resolution to vacate portion of JB Farm Road. Motion carried.
Take Action re: Road Vacation, set appropriate dates for Public Hearing Moved by Doug Yelk, second by Vernon Pogue to set public hearing date for road vacation to be held at Town Board meeting on December 13, 2004. Motion carried.
Consider and Take Action re: Amendments to Building Code Ordinance concerning swimming pools and detached garages and accessory buildings Moved by Doug Yelk, second by Vernon Pogue to approve the amendments to the building code ordinance concerning swimming pools in Section 15-1-8(a)(1) Exemption. Storable swimming or wading pools with a maximum dimension of fifteen (15) feet or a maximum wall height of fifteen (15) inches and is so constructed that it may be readily disassembled for storage and reassembled into its original integrity are exempt. And in Section 15-1-8(c)(2) The enclosure may be omitted where above ground pools are installed and have a sidewall height from grade of a minimum of 48 inches. When pool ladders are provided they shall be a type that can be and shall be tilt up. Motion carried.
Moved by Doug Yelk, second by Vernon Pogue to approve amendment to building code ordinance regarding detached garages and accessory buildings Section 15-1-3(c)(7) Detached Garage and Non-Agricultural Buildings. Detached buildings, not used as a dwelling unit but incidental to that of main buildings, that is located on the same lot. Accessory buildings do not mean farm (ag) buildings. Motion carried.
Consider and Take Action on Petition #9062, B. Averill, as amended by the County Board Moved by Doug Yelk, second by Vernon Pogue to approve petition #9062 for Ben Averill as amended by the County Board. Motion carried.
Audit and Pay Bills Moved by Vernon Pogue, second by Doug Yelk to approve the payment of bills as presented. Motion carried.

Set Next Meeting Date/Adjournment The next meeting date was set for Monday, November 8, 2004 at 7:30 P.M. Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting. Motion carried. The chairman declared the meeting adjourned at 9:05 p.m.
