General Guidelines on Land Use Changes

The following information is to help you through the process of rezoning, conditional use permit application and land divisions.  A packet of information may also be picked up at the Sun Prairie Town Hall.  Dane County Ordinance Chapter 10 governs zoning and conditional use permits. The process can be divided into the following steps:

1. Complete the attached preliminary plan form and return to the Town Clerk with $20.00 fee.

2. Your request for review of preliminary plans will be added to the agenda of a Town Board meeting.

3. A copy of the agenda will be sent to you. You will need to attend this meeting.

4. The Board will review your intent and request. The Board will not approve or disapprove your request at this time. They will inform you of any questions and/or concerns they have regarding your intentions. You will be able to determine whether you should proceed with your plans. This meeting should occur prior to your application at the county level.

5. At this point, if the Board is satisfied with your plans you can make an application for a re-zone etc. at Dane County Planning and Development, Room 116, City County Building, 210 Martin Luther King, Jr. Blvd., Madison.  266-4266

6. The County will establish county public hearing dates for your petition.

7. The County will then provide the Town with copies of your formal application, county hearing notices and maps,

8. The Town Board will hold a public hearing in conjunction with a Town Board meeting. You will be notified of this, as will neighboring land owners. You or your agent will need to attend this meeting. The Board may take action on your petition during this meeting or they may delay action.

9. The County Zoning and Natural Resource Committee will hold a public hearing, the applicant or his/her agent is required to attend. The county committee will not take action on that evening.

10. The Town notifies the county of their approval or denial of the petition.

11. Following a decision by the county zoning and natural resource committee the petition is referred to the County Board for their action.

12. County Board and County Executive approval are necessary for a rezone to become effective.

13. If your application includes a delayed effective date, you will need to have a certified survey map approved by the County and the Town Board. The map will need to be registered with the Register of Deeds office within 90 days or the zoning will revert to the previous classification.
