Town Board Minutes for April 9, 2007

Call to Order.  The meeting was called to order at 7:30 p.m. by chairperson Lyle Updike.  Supervisors Vernon Pogue and Doug Yelk and clerk Claudia Quick were present.  No one else attended the meeting.

Statement of Public Notice.  The chair directed that the minutes show notice of the meeting was published in the April 5, 2007 issue of The Star; notice was also faxed to the Capital Times.  Copies were also posted on the three town bulletin boards on April 5, 2007.

Pledge of Allegiance.  Doug Yelk led the pledge.

Approve Minutes of Prior Meeting.   Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the March 26, 2007 meeting.

Presentation from the Public.  none

Report on Town Roads.  Dennis Farrell was not present, but asked the clerk to report that the roads are stabilizing.

Consider and Take Action re: Coleman Rezone petition as amended.  Dane County Zoning and Land Regulation Committee and the County Board have both approved the Coleman petition.  However in the process a member of the ZLR committee requested that the metes and bounds description include land north to the ROW of CTH T.   Moved by Vernon Pogue, second by Doug Yelk to make mention in the minutes of this meeting that including the Right of Way does not make this a saleable lot.  The metes and bound description describes a spot zone.  Mr. Pogue accepted the amendment.

Consider and Take Action re: revised Independent Inspection Fee Schedule.  Moved by Vernon Pogue, second by Doug Yelk to approve the revised fee schedule of  4 cents per sq ft.  for agricultural buildings not requiring a Site Permit (inspections required). This fee applies to ag type building on non-farm parcels, i.e. pole sheds for horses on a 4-acre lot, etc.

Discuss Impact Fee vs. Fee in Lieu of Land.  Clerk Claudia Quick reported that at a recent seminar concerning impact fees she learned that it is her understanding that the park fee which the Town of Sun Prairie has is not an impact fee.  That is because the requirement is in our land division ordinances and the payment is in lieu of land.  Also there is no requirement to refund unused funds.  She has requested an opinion from Attorney Hazelbaker.

Audit and Pay Bills.  The Board reviewed the list of invoices for April.  Moved by Doug Yelk, second by Vernon Pogue to pay the April bills with the addition of the handwritten items.

Old Business/New Business.  Vernon Pogue, reporting for the Marshall EMS indicated that the Waterloo Courier, a weekly local paper, has made an open records request for EMS payroll information

Set Next Meeting Date/Adjournment.  The next meeting date was set for April 23, 2007.  Moved by Vernon Pogue, second by Doug Yelk to adjourn the meeting.
