The Town Board of the Town of Sun Prairie met on Monday, October 27, 2008, at 7:30 p.m. at the Town Hall, 5556 Twin Lane Road, Marshall, WI.
Call to Order. The meeting was called to order at 7:30 p.m. by chairperson Lyle Updike. Supervisors Vernon Pogue and Doug Yelk and clerk Claudia Quick, treasurer Cindy Yelk, and office assistant Jo Ann Ramsfield were present. No one else was present.
Statement of Public Notice. The chair directed that the minutes show notice of the meeting was published in the October 23 issue of The Star. Copies were also posted on the three town bulletin boards on October 23, 2008.
Pledge of Allegiance. Jo Ann Ramsfield led the pledge.
Approve Minutes of Prior Meetings. Moved by Vernon Pogue, second by Doug Yelk to approve the minutes of the October 13, 2008 Town Board meeting as written.

Consider Preliminary Adoption of Ordinance re: Firearm Restriction in Town of Sun Prairie. Motion by Doug Yelk to give preliminary approved to the Firearm Restriction in the Town of Sun Prairie. The ordinance is modeled after the Town of Cottage Grove Ordinance. Moved by Lyle Updike, second by Vernon Pogue.

Publication Discussion: Post Draft Firearm Restriction on the Town of Sun Prairie. Adoption will be at the November 24th Town Board Meeting.
Consider and Take Action re: Town’s New Authority over Conditional Use Permits. The Planning Commission (PC) will hear petitions for new and changes to Conditional Use Permits. PC will make recommendations to the Town Board. The Town Board will make the final ruling; findings are necessary for denial in six categories. Legal counsel should be considered when appropriate.
Consider and Take Action re: EMS arbitration issue. The Town Chairs and Village President will continue discussions. Judge Angela Bartell was appointed as the arbitrator for the Town of Medina. She has asked to be appointed as sole arbitrator. The Towns of Medina and Sun Prairie will split the attorney cost.
Consider hiring attorney. Motion by Doug Yelk, second by Vernon Pogue to approve joint representation by the Town of Medina attorney, Gene Reynolds.
