Plan Commission Minutes 10/17/16

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Alan Meyer, Paul Stang, John Quimby and Doug Yelk.  Excused:  Jane Case and Dot Havens.  Also present:  Town Chairman Lyle Updike.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on October 11, 2016.

Approve the minutes of previous meeting.  Hearing no objections, the September 19, 2016 minutes were approved as submitted.

Lyle Updike provided an update on the progress of the Dane County Towns Association committee drafting a zoning ordinance for towns considering withdrawing from Dane County zoning.

The proposed zoning ordinance was reviewed and corrections, edits and revisions were suggested to take back to the drafting committee.

Changes to the Town’s Comprehensive Plan to conform to the Town zoning under the proposed zoning ordinance were presented and discussed.

The proposed zoning ordinance requires the Town to create an Official Town Map.  Assistance from Dane County planning will be requested to develop a digital map using geographical information systems methods.

At the December meeting a public hearing will be held to allow the public to be heard on the proposed zoning ordinance, changes to the Comprehensive Plan and a proposed Official Map.

Set Next Regular Meeting Date.   The next regular meeting date of the Town of Sun Prairie Plan Commission is scheduled for November 21, 2016 at 7:00 p.m.

Plan Commission Minutes 9/19/16

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Dot Havens, Alan Meyer, Paul Stang, John Quimby and Doug Yelk.  Also present:  Robert Heineman.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on September 14, 2016.

Approve the minutes of previous meeting.  Hearing no objections, the August 15, 2016 minutes were approved as submitted.

Consider and take action on a preliminary plan by Birrenkott Surveying, representing Bernie and Barbara Heinemann, to rezone 0.32 acres of a 34.8 acre parcel from A-1(Ex) Agricultural to C-1 Commercial to bring the area into compliance for its existing commercial use at 4545 Highway TT in Section 33, Town of Sun Prairie.

An issue arose regarding storm water runoff from the parking lot and soil erosion onto the farmer’s field to the east of the proposed rezoning.  A series of aerial maps taken at various intervals over the last 10 years show runoff caused erosion and the farmer built a floodway to help discharge the water from his land.

Motion by Yelk/Quimby to tentatively approve the rezoning as requested, with agreement from the applicant to accept additional legal expenses, the Plan Commission will seek legal advice from the Town’s Legal Counsel regarding water management issues.  Motion carried, 6 ayes, 1 no.

Plan Commission Minutes August 15, 2016

Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Dot Havens, Alan Meyer, Paul Stang, John Quimby and Doug Yelk.  Also present:  John Schiltz and Al Kelly.

Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on August 10, 2016.

Approve the minutes of previous meeting.  Hearing no objections, the July 18, 2016 minutes were approved as submitted.

Consider and take action on a preliminary plan by John and Sarah Schiltz to rezone 2 acres of a 32.84 acre parcel from A-1(Ex) Agricultural to R-1 Residential to separate a residential parcel from the rest of the farm for a new single family home at 2969 Highway T in Section 30, Town of Sun Prairie.

Discussion considered the following issues:
The proposed parcel is all prime farmland according to NRCS Soils Survey map
The LESA score of 92.9 exceeds the 73 above which residential rezoning is not approved
The parcel is adjacent to navigable stream which requires a 75 ft setback for any development
Parcel within 300 ft in shoreland  district requiring compliance with shoreland permitting

After considering the issues, no action was taken to approve the request

Plan Commission Minutes 7/18/16

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, Dot Havens, Alan Meyer, John Quimby and Doug Yelk .  Absent:   Paul Stang.  Also present:  Board members Lyle Updike, Doug Yelk and Vernon Pogue.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on July 12, 2016.
  3. Approve the minutes of previous meeting.  Hearing no objections, the June 20, 2016 minutes were approved as submitted.
  4. The Plan Commission met in joint session with the Town Board to hear a briefing and discussion on 2015 Wisconsin Act 178 (“Opting Out” of Dane Zoning) by representatives from the Dane County Towns Association and Dane County Planning and Development.  Presenters were:  Mark Hazelbaker, Attorney for Dane County Towns Association; Todd Violante, Director, Dane County Planning and Development, and Majid Allen, Senior Planner, Dane County Planning and Development.

Documents were provided by each presenter for discussion.  The Town will have the option of remaining under Dane County Zoning Ordinance (Chapter 10), withdraw from Dane County zoning and conduct zoning operations under a joint Dane County Towns Ordinance, or continue to use the Dane County Zoning Ordinance (Chapter 10), but not subject to the direction and approval of Dane County authorities.  If the Town intends to withdraw, it will be required to give notice of intend by October 20, 2016 for implementation starting January 2017.

Withdrawing from county zoning would give the Town of Sun Prairie its own right to establish zoning policies and make its own zoning decisions, subject to Wisconsin Law, without further oversight.  It is recognized that the consequences of withdrawing from County zoning would result in the loss of valuable county resources and administrative services.  Further discussion will continue.

Plan Commission Minutes 6/20/16

  1. Call to Order.  The regular meeting of the Town of Sun Prairie Plan Commission was called to order at 7:00 p.m.  The following members were present:  Chairman Roger Fetterly, Jane Fiala, John Quimby and Doug Yelk .  Absent:  Dot Havens, Alan Meyer and Paul Stang.  Also present:  Scott Foley and Gavin Hallman.
  2. Public Notice.  Notice of the meeting was mailed to Plan Commission members and posted on the three Town bulletin boards on June 14, 2016.
  3. Approve the minutes of previous meeting.  Hearing no objections, the May 17, 2016 minutes were approved as submitted.
  4. Recess for comments by visitors:  No one appeared.
  5. Consider and take action on a request for Design Review by Ultimate Construction Inc., representing owner Bill Hallman,  for construction of a 50’ x 133’, 6650 s/f  building containing office and storage space on a 1.7 acre C-2 Commercial parcel at 2776 LaRue Fields Lane, in Section 32, Town of Sun Prairie. Motion by Yelk/Quimby to approve the design as proposed with an additional requirement that tree and/or shrub screening be provided on the east side of the parcel adjacent to LaRue Fields Lane.  Motion carried.
